Terms of Service

1. Acceptance of terms
By accessing or using the Creatives.KE website at creatives.ke (“the Site”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you must not use the Site.
2. About the Site
Creatives.KE is operated from Nairobi, Kenya. The Site provides a curated Opportunities Hub, research publications, a journal, an events calendar, and related informational services for Kenya’s creative economy. Some features are under development and will be made available progressively.
3. Opportunities Hub
The opportunities listed on the Site are sourced from publicly available information and community submissions. Every listing is reviewed by our team before publication. Notwithstanding our review process:
- We do not guarantee the accuracy, completeness, timeliness, or continued availability of any listed opportunity. Deadlines, eligibility criteria, and funding amounts may change at any time without notice to us.
- Inclusion on the Site does not constitute an endorsement, recommendation, or guarantee of any programme, funder, or organisation.
- We are not affiliated with the organisations behind listed opportunities unless explicitly stated.
- You are solely responsible for independently verifying the details of any opportunity before applying or committing resources.
4. Community submissions
Users may submit opportunities for review. By submitting, you represent and warrant that:
- The information you provide is truthful and accurate to the best of your knowledge.
- The source URL links to a publicly accessible, legitimate page.
- Your submission does not infringe any third party’s rights.
We reserve the absolute right to accept, reject, edit, or remove any submission at our sole discretion, without obligation to provide reasons. Published submissions may credit the submitter by name, unless they chose to remain anonymous.
5. Intellectual property
All content, design, logos, graphics, and software comprising the Site (collectively, “Site Materials”) are the property of Creatives.KE or its licensors and are protected by applicable intellectual property laws.
You may:
- Share links to any public page on the Site.
- Quote or excerpt published research with clear attribution (“Source: Creatives.KE, creatives.ke”).
You may not:
- Reproduce, distribute, or create derivative works based on the Site Materials without our prior written consent.
- Extract, scrape, or systematically download substantial portions of the Site’s content or data.
- Represent our content as your own or remove any attribution or proprietary notices.
6. Prohibited conduct
You agree not to:
- Submit false, misleading, or fraudulent information through any form on the Site.
- Use the Site for spam, unsolicited advertising, or any unlawful purpose.
- Attempt to gain unauthorised access to any part of the Site, any account, server, system, or network connected to the Site.
- Probe, scan, or test the vulnerability of the Site or any related system, or attempt to breach, bypass, or circumvent any security, authentication, or access-control measure.
- Use automated tools, bots, scrapers, or crawlers to access or extract data from the Site, except for standard search-engine indexing conducted in compliance with our robots.txt.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, architecture, or internal workings of the Site.
- Interfere with, degrade, or disrupt the performance, availability, or integrity of the Site or its underlying systems.
- Impersonate any person or entity, or misrepresent your identity or affiliation.
7. Confidentiality of systems
The technical architecture, infrastructure, database design, security configurations, authentication mechanisms, source code, internal tools, credentials, and all other non-public aspects of the Site (“Confidential Systems”) are the exclusive confidential property of Creatives.KE. No right or licence to access, inspect, disclose, or exploit any Confidential System is granted by these Terms or by your use of the Site.
Any unauthorised access to, interference with, or disclosure of Confidential Systems may constitute a criminal offence under the Computer Misuse and Cybercrimes Act, 2018 (Kenya), and we reserve the right to pursue all available legal remedies, including reporting to law enforcement authorities.
8. External links
The Site contains links to third-party websites, including opportunity source pages and partner sites. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, privacy practices, or availability of any external site.
9. Disclaimer of warranties
The Site and all content, information, and services provided through it are offered on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We are not responsible for any loss or damage resulting from your reliance on information obtained through the Site.
10. Limitation of liability
To the fullest extent permitted by the laws of Kenya, Creatives.KE, its officers, directors, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, or opportunities — arising out of or in connection with your access to or use of the Site, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Creatives.KE and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Site.
12. Termination
We may restrict, suspend, or terminate your access to the Site at any time, with or without notice, for any reason, including but not limited to a violation of these Terms. The provisions of Sections 5, 7, 9, 10, 11, and 13 shall survive termination.
13. Governing law & jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Kenya.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect.
15. Changes to these terms
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with a revised effective date. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.
